Name, Image, and Likeness Guidelines for Student-Athletes
  • Student-athletes in the state of Florida may earn compensation for use of their name, image or likeness (NIL) without affecting their athletics eligibility or grant-in-aid. Student-athletes earning NIL compensation must do so in accordance with the Florida NIL Law (Section 1006.74, Florida Statutes). Such compensation must be within fair market value.

  • State College of Florida, the athletic department, staff members or boosters may not compensate or arrange compensation to a current or prospective intercollegiate athlete for her or his name, image, likeness.

  • Compensation may not be provided in exchange for athletic performance or attendance at State College of Florida.

  • NIL compensation may only be provided by a third party unaffiliated with State College of Florida.

  • Student-athletes will not be permitted to enter into NIL agreements with gambling/sports wagering vendors, any vendors associated with NCAA banned substances, athletic recruiting services, or alcoholic beverage vendors. 

  • The use of college facilities will require approval in advance (location agreements, including waiver of liability forms and applicable rental fees). Rental and waiver of liability agreements will be coordinated with the Business and Auxillary Services Department

  • All NIL deals (including paid, unpaid or in-kind) must be reported to the College before signing.  The College reserves the right to review all NIL agreements before they are fully executed. Use this form to report your intent to sign an NIL contract.

  • NIL deals may not extend beyond the student-athletes participation in athletics. 

  • A student-athlete under the age of 18 must satisfy Florida statutes 743.08 and 743.09 when entering into a contract for NIL compensation.

  • Student-athletes may only use an athlete agent or attorney for the purposes of securing NIL compensation. Student-athletes cannot secure agents or attorneys for the purpose of future representation in professional sports without risking their athletics eligibility. Any agent used for NIL purposes must be licensed in the state of Florida, and any attorney used for NIL purposes must be a member in good standing of The Florida Bar.  Use this form to report your agent/attorney to SCF.

  • The state law prohibits student-athletes from entering into a contract for NIL compensation that conflicts with a term in an SCF team contract.

  • NIL compensation activities may not occur during department or team related activities

  • SCF Logos may not be used without prior approval.  See the Athletic Director for more information.

  • The expectation is that NIL compensation opportunities will not conflict with academic or team related activities.

  • Pell Grant or need based financial aid could be impacted based on compensation from Name, Image and Likeness. Those questions should be directed to the Financial Aid Department

  • Please be aware that your NIL activities may have personal tax implications. These obligations are dependent upon individual circumstances and may require consultation with a tax professional.

  • International student-athletes should not enter into any NIL agreements without the guidance from the State College of Florida International Student Services to guard against any potential immigration or visa issues.
